Are U.S. Consulates targeting K-1 fiance visas? That is a recent allegation made by many couples and their immigration attorneys who have seen a more hostile approach taken by Consulates when interviewing foreign national fiances and fiancees. Whether or not the K-1 Visa is being targeted is difficult to discern. What is not difficult to discern is that applicants should be ready for either interviews and should know what to expect from the beginning of the K-1 visa process. Preferably, K-1 applicants should retain an immigration lawyer who focuses on K-1 visas to help guide a couple through the process.
The K-1 process is a long, drawn out process (much more so then need be). First, a U.S. citizen must petition the uSCIS. After the USCIS makes its decision, the petition is sent overseas to where the foreign national fiance(e) is waiting. The U.S. Consulate then interviews the foreign national and decides whether or not the foreign national is admissible and in a good faith relationship with the U.S. petitioner.
